Judge tosses out 4×4 lumber lawsuit against Menards

A federal judge has ruled that Illinois shoppers have no case against Eau Claire, Wis.-based Menards in a lawsuit in which the shoppers said the home store was deceitful about the size of its 4x4s.

Two separate lawsuits were filed in June against Menards and Home Depot. Each suit sought more than $5 million.

“We feel that it was a frivolous lawsuit at best and we’re glad that common sense prevailed,” a Menards spokesman told the Milwaukee Journal Sentinel.

The case against Home Depot is still pending.
